በፍ/ባለመብት ወ/ሮ ኃይማኖት ክብረት እና በፍ/ባለዕዳ ወ/ሮ እታገኝ ንጉሴ መካከል ስላለው የፍርድ አፈጻጸም ጉዳይ የፌዴራል መጀመሪያ ደረጃ ፍ/ቤት በመ/ቁ/ጥ/157179 በ7/5/2016 ዓ.ም እና በኮ/መ/ቁ/60042 በ11/4/2017 ዓ/ም በዋለው ችሎት በሰጠው ትዕዛዝ መሠረት ለማስፈጸም እንዲቻል በአቃቂ ቃሊቲ ክ/ከተማ ወረዳ 8 ክልል የሚገኝ በይዞታ መለያ ኮድ AA000070803259 በፍ/ባለዕዳ በአቶ ፍቅሩ ወ/ሰማያት ተ/ሀዋሪያ ስም ተመዝግቦ የሚገኝ የቦታው ስፋት 86 ካ/ሜ ከይዞታው ላይ 12 ካ/ሜ የመንገድ ጥናት የሚነካው በባለሙያ ግምት የሐራጅ ሽያጭ መነሻ ዋጋ ብር 2,483,960 (ሁለት ሚሊዮን አራት መቶ ሰማኒያ ሦስት ሺህ ዘጠኝ መቶ ስልሳ ብር) ሆኖ የካቲት 4 ቀን 2017 ዓ/ም በሐራጅ ይሸጣል የሚል ማስታወቂያ ወጥቶ በእለቱ ተጫራች አልቀረበም፡፡ ይህንኑ ለፍ/ቤቱ ሪፖርት ተደርጎ ፍ/ቤቱ በ10/7/2017 ዓ/ም በድጋሚ ጨረታ እንዲወጣ ትዕዛዝ የሰጠ በመሆኑ በሁለተኛ ጨረታ የግምቱን 1/4ኛ ብር 620,990 (ስድስት መቶ ሃያ ሺህ ዘጠኝ መቶ ዘጠና ብር) በማስያዝ መሳተፍ የሚቻል ሆኖ የትራንዛክሽን ታክስ ገዥ የሚከፍል መሆኑ ታውቆ ሚያዝያ 24 ቀን 2017 ዓ/ም በሐራጅ ይሸጣል፡፡ የተጫራቾች ምዝገባ 9፡30 ሰዓት ተጀምሮ የቀረቡ ተጫራቾች ተመዝግበው እንደተጠናቀቀ ወዲያውኑ ጨረታው የሚካሄድ ይሆናል፡፡

የሐራጁ ሽያጭ የሚካሄደው በፌዴራል ፍርድ ቤቶች የፍርድ አፈጻጸም ዳይሬክቶሬት የጨረታ አዳራሽ ውስጥ ሲሆን፣ ንብረቱን ተጫርተው ለመግዛት የሚፈልጉ ተጫራቾች ከጨረታው ቀደም ብሎ ባሉት አራት የሥራ ቀናቶች ውስጥ ባለመብቱ ለማስጎብኘት በሚመርጧቸው ሶስት የስራ ቀናት በፌ/ፍ/ቤቶች ፍርድ አፈፃፀም ዳይሬክቶሬት ሐራጅ ክፍል ድረስ ከጠዋቱ በ3፡30 ሰዓት ብቻ በመገኘትና ባለመብቱ በሚያቀርበው ትራንስፖርት ንብረቱን ባለበት ቦታ ድረስ በመውሰድ ለመጐብኘት የሚችሉ ሲሆን፤ እያንዳንዱ ተጫራች በሚጫረትበት ወቅት የንብረቱን መነሻ ግምት 1/4 ኛውን በንግድ ባንክ በተረጋገጠ CPO ማስያዝ ይኖርበታል፡፡ ከ1/4ኛው አስበልጦም ሆነ አሳንሶ የሚመጣ ተጫራች በጨረታው አይካፈልም፡፡ በጨረታው አሸናፊ የሆነው ግለሰብ አሸናፊ የሆነበትን ገንዘብ በአጠቃላይ ጨረታውን ከአሸነፈበት ቀን ጀምሮ በፍ/አፈ/ዳ/ ስም CPO አሰርቶ በኢትዮጵያ ንግድ ባንክ ብቻ ሙሉ ገንዘቡን በ15 ቀናት ውስጥ ገቢ ማድረግ አለበት በጨረታ አሸናፊ የሆነ በጨረታ ያሸነፈበትን ገንዘብ ገቢ ሳይደረግ ቀርቶ በቀጣይ ጨረታ ተደርጎ ጨረታው ከበፊቱ ጨረታው ቀንሶ ከተሸጠ ገዥው በልዩነት ተጠያቂ እንደሚሆን የፍ/አፈ/ዳይሬክቶሬት ንብረቱን በህጋዊ መንገድ በሐራጅ ስለመሸጡ ለሚመለከተው አካል ማስረጃ ከመጻፍ ባለፈ ስም የማዛወር ግዴታ የሌለበት መሆኑን እንገልፃለን፡፡

የጨረታ መለያ ቁጥር 002/2017

በአዲስ አበባ አስተዳደር በለሚ ኩራ ክፍለ ከተማ ወ ዐ4 አራብሳ ጤና ጣቢያ ከዚህ በታች ለተዘረዘሩት ሎት የህትመት ስራዎች፤ ሎት 2. የህክምና መገልገያ መሳሪያ እና መድኃኒት፤ በግልፅ ጨረታ አወዳዳሮ ለመግዛት ይፈልጋል፡፡ በዚህ መሰረት ጨረታውን ለመሳተፍ የሚፈልጉ ህጋዊ ተጫራቾች የሚከተሉትን መስፈርቶች የሚያሟሉ መሆን አለባቸው፡፡

1. ተጫራቾች በዘርፍ የተሰማሩበትን ህጋዊ ፈቃድ ያላቸውና የዘመኑን ግብር ለመክፈላቸው ማስረጃ ማቅረብ የሚችሉ መሆን አለባቸው፡፡

2. በገንዘብና ኢኮኖሚ ልማት ሚ/ር በአቅራቢነት የተመዘገበና ማስረጃ ማቅረብ የሚችሉ መሆን አለባቸው፡፡

3. የታደሰ የንግድ ፈቃድ ያለው፣

4. ተጨማሪ እሴትታክስ የምዝገባ የምስክር ወረቀት ማቅረብ የሚችሉ፣ መሆን አለባቸው፡፡

5. ተጫራቾች ከዚህ በታች የተጠቀሰውን የጨረታ ማስከበሪያ በባንክ የተረጋገጠ CPO. ማቅረብ አለባቸው፡፡

6. የጨረታ ሰነዱን ማስታወቂያው ከወጣበት ቀን ጀምሮ በየሎቱ የማይመለስ ብር 100.00 / አንድ መቶ ብር በመክፈል የተዘጋጀውን ሰነድ ከተቋሙ ቢሮ ቁጥር 405 እየቀረቡ መግዛት ይቻላሉ፡፡

7. ተጫራቾች ጨረታው ከወጣበት ቀን አንስቶ ባሉት 10/አስር/ ተከታታይ የስራ ቀናት ቢሮ ቁጥር 303 ድረስ በመምጣት ዋጋው የተሞላበትን የጨረታ ሰነዱን ዋናውንና ፎቶ ኮፒ ለየብቻ በማሸግ ለዚሁ በተዘጋጀው የጨረታ ሳጥን ውስጥ ማስገባት አለባቸው፡፡

8. ጨረታው በ10ኛው ቀን ታሽጎ በዕለቱ ከቀኑ 8፡30 ሰዓት ታሽገው 9፡00 ሰዓት ተጫራቾች ወይም ህጋዊ ወኪሎቻቸው በተገኙበት ይከፈታል፡፡ የጨረታው መዝጊያና መክፈቻ የስራ ቀን ካልሆነ በሚቀጥለው የስራ ቀን በተጠቀሰው ተመሳሳይ ሰዓት ተጫራቾች ወይም ህጋዊ ወኪሎቻቸው በተገኙበት ይከፈታል፡፡

9. ተጫራቾች ያሸነፉበትን ዋና የውል ማስከበሪያ 10% ማስያዝ አለባቸው ፡፡

10. ተጫራቾች ጨረታው ከመከፈቱ በፊት ለሚወዳደሩበት ናሙና ለሚቀርብባቸው እቃዎች ናሙና ማቅረብ አለባቸው ፡፡ ናሙና የማይቀርብባቸው እቃዎች መስሪያ ቤቱ ባቀረበው ስፔስፊኬሽን መሠረት ማቅረብ አለባቸው፡፡

11 የጨረታ አሸናፊ ድርጅት ያሸነፈበትን እቃ በራሱ ትራንስፖርት ድርጅቱ ድረስ ማቅረብ ይኖርበታል፡፡

12. መ/ቤቱ ለጨረታ ከቀረበው እቃ እስከ 20% የመቀነስም ሆነ የመጨመር መብት የተጠበቀ ነው፡፡

13. ለጥቃቅንና አነስተኛ ተጫራቾች የድጋፍ (የዋስትና) ደብዳቤ ከተሰጠበት አካል ደብዳቤው በፅሕፈት ቤቱ ኃላፊ የፀደቀ እና የፅህፈት ቤቱ ኃላፊ ቲተር ያለው መሆን አለበት ፤ ከዛ ውጭ የማንቀበል መሆኑን እናሳውቃለን፡፡

14. መ/ቤቱ የተሻለ አማራጭ ካገኘ ጨረታውን ሙሉ በሙሉ ወይም በከፊል የመሰረዝ መብቱ . የተጠበቀ ነው፡፡

3. Bidders should have the following specific experience or capabilities

(i) Financial Capability

a. The bidder shall submit of audited financial statement or if not required by the law of the bidder's country, other financial statements acceptable to the Purchaser, for the last five (5) years to demonstrate the current soundness of the bidders' financial position and its prospective long term profitability. For the specific project experience requirement, the contract price of projects referenced by the Bidder shall be adjusted to reflect the current purchasing power of Ethiopian Birr by multiplying with Cn/Co factor, where Cn is the current selling exchange rate of 1 US Dollar to Ethiopian Birr which is taken at the 28th days prior to bid submission date and Co is the selling exchange rate of 1 US Dollar to Ethiopian Birr at the date of signing the contract. The basis of computing Dollar value of Birr shall be the selling exchange rate issued by the National Bank of Ethiopia.

Participatory Agriculture and Climate Transformation (PACT) Programme

Assignment Title: Community-Driven Approach Training and Landscape Development Plan

The Ministry of Agriculture has received financing from the International Fund for Agricultural Development (IFAD) towards the cost of the Participatory Agriculture and Climate Transformation (PACT) Programme and intends to apply part of the proceeds for the recruitment of consulting services.

The use of any IFAD financing shall be subject to IFAD's approval, pursuant to the terms and conditions of the financing agreement, as well as IFAD's rules, policies and procedures. IFAD and its officials, agents and employees shall be held harmless from and against all suits, proceedings, claims, demands, losses and liability of any kind or nature brought by any party in connection with the Participatory Agriculture and Climate Transformation (PACT) Programme.

The Programme aims to contribute to poverty reduction and improved resilience of the target rural households.' The Programme Development Objective (PDO) is to 'enable 150,000 rural households (men, women, youth and persons with Disabilities (PWDs) in selected kebeles to sustainably improve incomes, food and nutrition security and build resilience to shocks.

The Programme will be implemented in 9 regional states (Amhara, Oromia, Tigray, (central Ethiopia, Southern Ethiopia, Afar, SWE (South West Ethiopia), Sidama, and Somali). The Programme will be implemented over a seven-year period.

The scope of the Consultancy

The scope of this assignment encompasses the comprehensive application of PRA methodologies to support the development of LDIPS within the PACT Programme. This will involve a multifaceted approach, starting with the participatory data collection and analysis process. The team will conduct a series of PRA exercises, such as resource mapping, seasonal calendars, and focus group discussions, to gather insights and perspectives directly from the local communities. These community- driven data analysis sessions will ensure that the findings reflect the priorities and development challenges identified by the stakeholders, including marginalized groups.

Building on the PRA process, the team will then utilize the collected data and insights to inform the development of comprehensive LDIPS for the target landscapes. The consulting services implementation period is 4/four/ months.

The Ministry of Agriculture ("the client") now invites eligible consulting firms ("consultants") to indicate their interest in providing the services. Interested consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the services. The attention of interested consultants is drawn to IFAD's Anti-Money Laundering and Countering the Financing of Terrorism Policy' and the Revised IFAD Policy on Preventing Fraud and Corruption its Activities and Operations. The consultant shall not have any actual, potential or reasonably perceived conflict of interest. A consultant with an actual, potential or reasonably perceived conflict of interest shall be disqualified unless otherwise explicitly approved by the Fund. A consultant including their respective personnel and affiliates are considered to have a conflict of interest if they a) have a relationship that provides them with undue or undisclosed information about or influence over the selection process and the execution of the contract, b) participate in more than one EOI under this procurement action, c) have a business or family relationship with a member of the Purchaser's board of directors or its personnel, the Fund or its personnel, or any other individual that was, has been or might reasonably be directly or indirectly involved in any part of

(i) the preparation of this REOI.

(ii) the shortlisting or selection process for this procurement, or

(iii) execution of the contract. The consultant has an ongoing obligation to disclose any situation of actual, potential or reasonably perceived conflict of interest during preparation of the EOI, the selection process or the contract execution. Failure to properly disclose any of said situations may lead to appropriate actions, including the disqualification of the consultant, the termination of the contract and any other as appropriate under the IFAD Policy on Preventing Fraud and Corruption in its Projects and Operations.
